Terms & Conditions of use and supply

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products listed on our website, www.lucozadeshop.com (our site). Please read these terms and conditions carefully before ordering any products from our site. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.

Service Availability
By using this site, including when making any purchase of products, you agree to be bound by these terms and conditions. We reserve the right to update and/or amend these terms and conditions from time to time, so you are advised to check them regularly. In respect of any order for the purchase of products, that order will be governed by the terms and conditions in place at the date of that order (subject to any subsequent amendments required by law). This site is intended for use by people resident in the United Kingdom. We do not accept orders from individuals outside of the United Kingdom.

Your Status
By placing an order through our site, you warrant that:
- you are legally capable of entering into binding contracts;
- you are at least eighteen (18) years old; and
- you are resident in the United Kingdom.
Prices
The price of any products will be as quoted on our site from time to time except in cases of obvious error. These prices include VAT but exclude delivery costs which will be added to the total amount due as set out in the Purchase Section. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent out a confirmation.
Occasionally, despite our best efforts, there may be an error in the price attributed to a product on the relevant product information page. In these circumstances, at our discretion we will charge the lower of the actual price and the price indicated on the product information page.

Purchase of Products
From your Shopping Basket, you may either continue shopping or proceed to purchasing the contents of the Shopping Basket.
To purchase your Shopping Basket, click on the 'Checkout' button and you will be transferred to the Checkout page, which will display the value of the products in your Shopping Basket and the postage price.
You will be asked to select a credit card from which payment will be taken and to submit your credit card information to our secure server. All products are available for purchase using either MasterCard, Maestro, Visa, Visa Delta, Visa Electron, Visa Purchasing, Switch or Solo. You will be charged at the time that you place your order.
Once you are happy with the details that you have provided, you can confirm your order by clicking the 'Make payment' button. This will create your order, which will be communicated to us. You will receive an email from us confirming receipt of your order; however, orders will not be accepted until delivery is made by us.
We reserve the right not to accept any order of over £1,000.

Delivery
We can only deliver to addresses in the United Kingdom (excluding the Channel Islands and PO Box addresses).
We offer free delivery on all orders of £15.00 or more. Orders under £15.00 will incur a delivery charge of £4.99. We aim to deliver all orders to your door within 4 working days from the receipt of your order. All delivery timings are estimates only. It is your responsibility to ensure that someone is available at the delivery address to accept, via signature, receipt of the products. This signatory does not have to be the same person as the name provided on the delivery package.
If you would like to receive your order earlier then we also offer a next (working) day delivery service for an additional fee of £4.99. Please note, that for next day delivery, orders have to be placed before 1pm. There are no weekend deliveries.

Our Contract
On submission of an order, you will receive an email from us confirming receipt of your order. This confirmation will include details of the products ordered and the estimated delivery time. Your order will constitute an offer to us to purchase the products in question; we will transfer your payment on receipt of the order, although if we are unable for any reason to process delivery of the order we will give you a full refund for the undelivered products. We will not be deemed to have accepted your order, and a contract will not be formed, until your products have been dispatched to your delivery address. Where we have dispatched only some of the products contained in an order, the order for the remaining un-dispatched products will not be deemed accepted until they themselves are dispatched.

Returns and Refunds
In the unlikely event that you are not satisfied with your products, you can return your products to us for a refund or to exchange for similar priced items at any time within seven (7) working days beginning on the day after you have received the products. A returns form is printed on the reverse of the despatch note sent with your order; please use this form for all returns to us. If you no longer have this form, please contact our Customer Services team on 0845 602 1496 for a replacement.
If for any reason you feel the quality of the product is not as expected or you feel that the products have produced ill effects, then please contact our Customer Service team immediately on 0845 602 1496.
Please note that we can only refund or exchange products purchased through this site. If you purchased the product elsewhere, please contact that retailer directly.
Products returned for taste reasons can only be refunded or exchanged if you only used 1-3 servings (with case items like drinks, stick packs, bars, a serving would count as one of the individually wrapped items. With tubs, it will be based on the scoops).
We reserve the right not to refund postage (unless you are returning defective products). If we do elect to return postage to you (for non-defective returns), it will be refunded with a gift voucher for use on the site.
If you take advantage of any multi-buy offer or discount, you will be refunded according to the discount that was applied to the order.
Please allow at least thirty (30) working days from the date you either notify us of the cancellation of your order or date that you return your order, for your refund or exchange to be processed.
We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

Cancellations
You have the right to cancel an order at any time within 7 days working days beginning on the day that you received your order by contacting our Customer Services team on 0845 602 1496.
If your order has not been despatched from our warehouse we will cancel the order and refund you in accordance with our returns and refund policy in section 8. If the order has already been despatched and we are not able to cancel the order you may return the order once you have received it in accordance with our returns and refund policy in section 8.

Availability
Where products are unavailable for purchase, this will be marked on the relevant product information page. However, the availability of a product cannot be guaranteed by its availability being shown on the relevant product information page. Despite our best efforts to keep the pages as up-to-date as possible, the availability of a product may alter in advance of the information on the relevant product information page being updated; this may lead to us being unable to accept an order. In these circumstances - subject to cancellation by you, we will keep your order open until fresh stocks of the product are received. We will inform you by email if we are unable to process, or otherwise accept, your order within 30 days of the date of your order, in which case you will be given the option either of being reimbursed the value of your order or of resubmitting or substituting your order.

This site is controlled and operated by us from our offices in the UK. We make no representation that material in the site is appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.
We use reasonable efforts to regularly update the site, but make no representation or warranty in respect of accuracy or lack of errors.
Use of the site is at the risk of the user. We take no responsibility for direct, indirect or consequential loss from use of the site and all implied warranties are excluded to the extent permissible under English law.
We accept no liability for viruses infecting the user following its use of the audio, video, data or text on the site.

Our Liability
We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all purposes for which products of the kind are commonly supplied.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the products you purchased.
Without in any way limiting our liability for death and/or personal injury caused by our negligence or breach of duty, we will not be liable for any direct, indirect or consequential loss. Without limiting your statutory rights, we will not be held liable for any failure to fulfil our obligations hereunder caused by events beyond our reasonable control. No failure by us to enforce a right hereunder will be deemed a waiver of that right.
Any condition or term herein deemed for any reason invalid or legally unenforceable will be deemed severable from these terms and conditions and will not affect the enforceability of the remaining terms and conditions.

Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations in connection with an order that is caused by events outside our reasonable control (“Force Majeure Event”).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
- Strikes, lock-outs or other industrial action.
- Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
- Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
- Impossibility of the use of public or private telecommunications networks.
- The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under in regards to any order is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

Written Communications
You agree that communications between you and us will be made by email or other electronic means, and you consent to receive all communications from us in an electronic format. By agreeing to these terms and conditions, you agree that you have elected to enter any agreement for the purchase of products electronically and to receive any required communications, notices or updates in an electronic format.
Assignment
You may not transfer or assign any of your rights under these terms and conditions. We may transfer or assign any of our rights or obligations at any time where we reasonably believe that your rights will not be affected.
Government Law
These terms and conditions and any orders made from the site are governed by English law. Any dispute or conflict arising out of or in connection with these terms and conditions or an order from the site shall be subject to the exclusive jurisdiction of the English courts.
Entire Agreement
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any order and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

The Lucozade Sport Shop promotional codes are available to UK residents for purchases from lucozadeshop.com only, while supplies last. When ordering please enter the relevant promotional code at the checkout to qualify for your discount (such discount shall not apply to any cost for postage and packaging). GSK reserves the right to withdraw offers at any time. Promotional codes may not be used in conjunction with any other offer or merchandising promotions (including training packs and multi-buys).
